Maternity leave benefits are provided for in both the Employment Act and the Children Development
Co-Savings Act.

How Long Is Statutory Maternity Leave?

 •    Statutory maternity leave has been extended from 8 to 12 weeks for eligible female
      employees from 1 October 2004.

 •    The extended 4 weeks (maximum 24 days) can be taken flexibly, with the employer's
      consent, within 6 months from the child's birth. Otherwise, the additional 4 weeks must
      be taken as a block immediately after the first 8 weeks.

 •    Employers can give maternity leave and benefits beyond the statutory minimum.

 Who Is Eligible?

 Under The Children Development Co-Savings Act

 •    Your employee is legally entitled to 12 weeks of paid maternity leave regardless of her
      occupation, if:

           o    her child is a Singapore Citizen; and

           o    she is lawfully married to the child's father at the time of the child's
                 conception or birth; and

           o    she has fewer than 4 other living children at the time of confinement; and

           o    she has served your company for at least 180 days before the birth of the child.

 •    You will pay her salary for all 12 weeks of maternity leave for the first 4 children:

           o    for the first 2 confinements, the 9th to 12th week is funded by the Government,
                 capped at S$10,000 (including CPF contributions) per confinement.

           o    for the third and fourth confinements, the Government will fund the full 12 weeks,
                 capped at S$30,000 (including CPF contributions) per confinement.

 Under The Employment Act

 •    If your employee does not meet the above criteria but is covered under the Employment Act,
      she is also legally entitled to 12 weeks of maternity leave for all births.

 •    You are required to pay her salary for the first 8 weeks of the first 2 confinements, if she
      has been in service for at least 180 days before the birth of her child.

 •    Managerial, executive or confidential staff are not covered under the Employment Act.

Are Self-Employed Mothers Entitled?

 •    Self-employed mothers are also eligible for the Children Development Co-Savings Act, if:

            o    your child is a Singapore Citizen; and

            o    you are lawfully married to the child's father at the time of the child's conception
                  or birth; and

            o    you have fewer than 4 other living children at the time of confinement; and

            o    you have been engaged in a particular business, trade, profession or vocation for a
                  continuous period of at least 180 days before the birth of your child, and

            o    you have lost income as a result of not engaging in your trade, business, profession
                  or vocation during the maternity leave period.

 •    You will be granted up to 4 weeks of Government-paid maternity leave (capped at S$10,000 per
      confinement) for the first 2 confinements.

 •    For the third and fourth confinements, up to 12 weeks of Government-paid maternity leave
      (capped at S$30,000 per confinement) will be granted.
